These Terms of Use ("TOU") aim to legally frame the modalities of provision of the site and services by SCAN-IMMO and define the conditions of access and use of the services by "the User."

These TOU are accessible on the site under the "TOU" section.

Any registration or use of the site implies the user's unconditional acceptance of these TOU. Upon registration on the site through the Registration Form, each user explicitly accepts these TOU by ticking the box preceding the following text: "I acknowledge having read and understood the TOU and I accept them."

Should the user not accept the TOU stipulated in this contract, they must forego access to the services offered by the site.

www.racket-trip.com reserves the right to unilaterally modify the content of these TOU at any time.

Welcome to Racket Trip, an international multilingual platform dedicated to connecting professionals in the racket sports world (coaches, clubs, or operators) and trainees, whether individuals or businesses, looking for internships in various racket sports such as tennis, padel, squash, badminton, table tennis, beach tennis, pickleball, and all other types of racket sports.

The site is freely accessible anywhere to any User with Internet access. All costs incurred by the User to access the service (computer hardware, software, Internet connection, etc.) are at their expense.

Non-member Users do not have access to reserved services. To access them, they must register by filling out the form. By agreeing to register for the reserved services, the member User commits to providing truthful and accurate information concerning their civil status and contact details, including their email address.

To access the services, the User must then log in using their username and password, which will be communicated to them after their registration.

Any regularly registered member User may also request to unsubscribe by visiting the dedicated page in their personal space. This will be effective within a reasonable period.

Any event due to force majeure resulting in the malfunction of the site or server and subject to any interruption or modification in case of maintenance, does not engage the responsibility of www.racket-trip.com. In such cases, the User therefore agrees not to hold the publisher accountable for any interruption or suspension of service, even without notice.

ARTICLE 3: DATA COLLECTION

The site ensures the User's collection and processing of personal information with respect for privacy in accordance with Law No. 78-17 of January 6, 1978, relating to data, files, and freedoms.

ARTICLE 4: INTELLECTUAL PROPERTY

The trademarks, logos, signs, as well as all the contents of the site (texts, images, sound, etc.) are protected by the Intellectual Property Code, particularly by copyright.

The Racket Trip brand is a registered trademark by Franck Binisti. Any representation and/or reproduction and/or partial or total exploitation of this brand, of any kind, is entirely prohibited.

The User must seek prior authorization from the site for any reproduction, publication, copy of various contents. They commit to using the contents of the site in a strictly private context; any use for commercial and advertising purposes is strictly prohibited.

Any total or partial representation of this site by any process whatsoever, without the express permission of the website operator, would constitute an infringement punishable by articles L 335-2 and following of the Intellectual Property Code.

It is reminded in accordance with article L122-5 of the Intellectual Property Code that the User who reproduces, copies or publishes protected content must cite the author and source.

Racket Trip acts exclusively as a platform for connecting professionals and trainees. We do not intervene in the exchanges, negotiations, or agreements made between professionals and trainees. As a result, Racket Trip does not receive any commission on the advertisements published on the site or on transactions and does not act as an intermediary in the established contractual relationships.

The sources of information disseminated on the site www.racket-trip.com are deemed reliable, but the site does not guarantee it is free of defects, errors, or omissions. Advertisers are entirely responsible for their content.

The information provided is presented for indicative and general purposes without contractual value. Despite regular updates, the site www.racket-trip.com cannot be held responsible for the modification of administrative and legal provisions occurring after publication. Similarly, the site cannot be held responsible for the use and interpretation of the information contained in this site.

The User ensures to keep their password secret. Any disclosure of the password, in any form, is prohibited. They assume the risks related to the use of their username and password. The site disclaims all responsibility.

The site www.racket-trip.com cannot be held responsible for any viruses that could infect the computer or any computer equipment of the Internet user, following use, access, or downloading from this site.

The liability of the site cannot be engaged in case of force majeure or the unforeseeable and insurmountable act of a third party.

Hyperlinks may be present on the site. The User is informed that by clicking on these links, they will leave the site www.racket-trip.com. The latter has no control over the web pages on which these links lead and cannot, under any circumstances, be responsible for their content.

ARTICLE 7: COOKIES

The User is informed that during their visits to the site, a cookie may automatically install on their browser software. Cookies are small files stored temporarily on the hard disk of the User's computer by your browser and are necessary for the use of the www.racket-trip.com site. Cookies do not contain personal information and cannot be used to identify someone. A cookie contains a unique identifier, randomly generated and therefore anonymous. ARTICLE 8: PUBLICATION BY THE USER

The site allows members to publish the following content: comments, a professional page, or advertisements.

In their publications, the member commits to respect the rules of Netiquette (rules of good conduct on the internet) and the rules of law in force.

The site may exercise moderation on the publications and reserves the right to refuse their posting online, without having to justify to the member.

The member remains the owner of all their intellectual property rights. But by publishing a post on the site, they grant the publishing company a non-exclusive, free right to represent, reproduce, adapt, modify, broadcast and distribute their publication, directly or through an authorized third party, worldwide, on any medium (digital or physical), for the duration of intellectual property rights. The Member notably grants the right to use their publication on the internet and on mobile telephone networks.

The publishing company commits to crediting the member's name near each use of their publication.

Any content uploaded by the User is their sole responsibility. The User agrees not to upload content that could harm the interests of third parties. Any legal action initiated by an injured third party against the site will be taken up by the User.

The User's content can be at any time and for any reason deleted or modified by the site, without notice.

ARTICLE 9: APPLICABLE LAW AND JURISDICTION

French law applies to this contract. In the absence of amicable resolution of a dispute arising between the parties, the French courts will have exclusive jurisdiction to hear it.
